These Terms of Use ("Terms") govern your use of iSea ("the app"), an iOS application for identifying and exploring marine life. By downloading or using iSea you agree to these Terms. If you do not agree, do not use the app.
You must be at least 13 years old to use iSea. By using the app you confirm that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You may sign in with Apple, Google, email and password, or as a guest. You are responsible for keeping your credentials secure and for all activity that occurs under your account. Notify us immediately at iseamarineid@gmail.com if you believe your account has been compromised.
Guest accounts have limited functionality and your data may not be recoverable if you uninstall the app without linking a sign-in method.
iSea offers monthly and annual auto-renewing subscriptions that unlock premium features including unlimited species identification.
You may post photos, captions, and comments ("Content") to the iSea community feed. By posting Content you represent that:
You retain ownership of your Content. By posting it you grant John Mackey a worldwide, non-exclusive, royalty-free license to display, distribute, and promote it within iSea and related marketing materials. This license ends when you delete the Content or your account.
iSea is a community built around a love of marine life. You agree not to post Content that:
We reserve the right to remove Content and suspend or permanently ban accounts that violate these guidelines, at our sole discretion and without prior notice.
iSea uses artificial intelligence to suggest possible species identifications. These suggestions are provided for informational and educational purposes only. They are not guaranteed to be accurate and should not be relied upon for:
Always exercise caution around marine life. Many species can be dangerous. John Mackey is not liable for any harm resulting from reliance on AI identification results.
All app code, design, species data, and other materials provided by iSea (excluding user-generated content) are the property of John Mackey and are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without prior written permission.
Your use of iSea is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
You may stop using iSea and delete your account at any time from Settings → Account → Delete Account. We may suspend or terminate your access at any time if you violate these Terms or for any other reason at our discretion. Upon termination, your license to use the app ends and we may delete your account data.
iSea is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of viruses.
To the maximum extent permitted by law, John Mackey shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of iSea, even if advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the twelve months preceding the claim.
These Terms are governed by the laws of the United States and the state in which John Mackey is domiciled, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts of that jurisdiction.
We may update these Terms at any time. Material changes will be communicated through the app or by updating the effective date above. Continued use of iSea after changes take effect constitutes your acceptance of the revised Terms.
